FEES FOR SERVICES BY THE DEPARTMENT OF HEALTH

ORDINANCE NO. 98-1

AN ORDINANCE ESTABLISHING SERVICE FEES TO BE CHARGED BY THE COUNTY OF HUNTERDON FOR SERVICES PERFORMED BY THE DEPARTMENT OF HEALTH IN ACCORDANCE WITH THE COUNTY ENVIRONMENTAL HEALTH ACT

WHEREAS, the County of Hunterdon Department of Health has been certified by the New Jersey Department of Environmental Protection as a local health agency and delegated the authority to implement and enforce various environmental health programs in accordance with the County Environmental Health Act (CEHA), N.J.S.A. 26:A2-21, et seq.

The Hunterdon County Department of Health, in accordance with its CEHA certification, reviews applications for potable water wells and individual subsurface sewage disposal systems to ensure that they are constructed, repaired and maintained in compliance with all standards of the Water Pollution Control Act, N.J.S.A. 58:10A-1, et seq., the Realty Improvement Sewerage Facilities Act, N.J.S.A. 58:11-23, et seq., the Safe Water Drinking Act, N.J.S.A. 58:12A-1, et seq., and an act concerning the protection of the subsurface and percolating waters of the State, N.J.S.A. 58:4A-4.1, and all rules and regulations adopted pursuant to those statutes. The County Department of Health, in its capacity as the lead local health agency for the County of Hunterdon under CEHA, also reviews subdivision plans and building permit referrals to determine that the sewage disposal system aspects of the proposed subdivision comply with the standards set forth in N.J.A.C. 7:9A-1.1 et seq., and that the proposed improvements for which a building permit is sought do not encroach on existing sewage disposal areas.

The Director of the County Department of Health, in his capacity as the CEHA health officer, has recommended adoption of an ordinance to establish fees to be charged by the County for services performed in connection with potable water wells and individual subsurface sewage disposal systems.

CEHA, at N.J.S.A. 26:3A2-34, permits the establishment of fees for services performed by CEHA agencies.

BE IT ORDAINED by the Board of Chosen Freeholders of the County of Hunterdon, that the Ordinance Establishing County Environmental Health Act Service Fees, be as follows:

Section I. - Authority:
This Ordinance is enacted pursuant to and consistent with the County Environmental Health Act, N.J.S.A. 26:3A2-21, et seq., the Safe Drinking Water Act, N.J.S.A. 58:12A-1, et seq., the Realty Improvement Sewerage Infrastructure Act, N.J.S.A. 58:11-23, et seq., the Water Pollution Control Act, N.J.S.A. 58:10A-1, et seq., an act concerning the protection of the subsurface percolating waters of the State, N.J.S.A. 58:4A-4.1, and all rules and regulations adopted pursuant to those statutes, including but not limited to N.J.A.C. 7:9A-1, et seq., and N.J.A.C. 7:1H-1.1, et seq.

Section II. - Purpose:
In order to ensure that:

Potable water wells are installed, constructed, maintained and abandoned in accordance with applicable statutes, rules and regulations;

Individual subsurface sewage disposal systems are installed, altered, repaired and maintained in accordance with all applicable statutes, rules and regulations;

Sewage disposal system aspects of proposed subdivisions referred by planning boards and other municipal agencies comply with all applicable statutes, rules and regulations; and

Proposed improvements, for which a building permit is required, do not negatively impact on existing sewage disposal areas as required by all applicable statutes, rules and regulations,

the County of Hunterdon Department of Health, a certified local health agency under the County Environmental Health Act (CEHA), N.J.S.A. 26:3A-21, et seq., reviews plans and activities which affect potable water wells and individual subsurface sewage disposal systems located within the Count of Hunterdon. This Ordinance establishes fees for services performed by the County of Hunterdon Department of Health.

Section III. - Service Fees:
All fees, with the exception of re-inspection or re-review fees, shall be paid in advanced at the time an application is made to the county of Hunterdon Department of Health. Fees for re-inspection or re-reviews shall be paid prior to issuance of approval by the Department of Health. All fees collected pursuant to this Ordinance shall be deposited in the County of Hunterdon’s Environmental Quality and Enforcement Fund in accordance with N.J.S.A. 26:3A2-34.

The service fees to be charged are as follows:

INDIVIDUAL SUBSURFACE SEWAGE DISPOSAL SYSTEM PROGRAM FEES

Re-Review (after initial plan rejection) $15.00

GEOTHERMAL WELL PROGRAM FEES

Geothermal Well Applications $125.00

Subsequent Inspections $45.00

SUBDIVISION PLAN REVIEW FEES

Site Plan $25.00

Minor (1-3 lots) $75.00

Major (4-10 lots) $110.00

Major (11-20 lots) $160.00

Major (21 or more lots) $245.00

CONSTRUCTION PERMIT REVIEW FEES

Permit Referral Review $15.00

GENERAL PROCESSING FEES

Refund Processing $25.00

Section IV. - Construction and Severability:

This Ordinance is to be liberally construed to effectuate its purposes.

If any section, subsection, paragraph, sentence, clause, phrase, or word contained in this Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance which shall remain in full force and effect.

Section V. - Repealer:

Any Ordinance or portion thereof enacted by the County, any municipality, board of health, or public entity within the County of Hunterdon that contains any subject matter governed by this Ordinance, which is inconsistent with or which stands as an obstacle to the effective implementation of this Ordinance shall be superseded by this Ordinance and is hereby repealed and set aside.

Section VI. - Effective Date:

This Ordinance shall take effect immediately upon final passage by the Board of Chosen Freeholders of the County of Hunterdon and publication as provided by law.
